Welcome to OneOhOne. By downloading, installing, or using our mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.
1. Acceptance of Terms
By accessing or using OneOhOne, you confirm that you are at least 13 years old and agree to comply with these Terms. If you do not agree to these Terms, you may not use the App.
2. Description of Service
OneOhOne is a mobile application that allows two people to maintain a simple daily check-in connection. The App enables users to:
- Send and accept invitations to connect with a partner
- Record daily check-ins with a single tap
- View their partner's check-in status
- Receive notifications about check-in activity
3. User Accounts
3.1 Account Creation
The App uses anonymous authentication. You do not need to create a traditional account with a username and password. Your app installation serves as your account identifier.
3.2 Account Responsibility
You are responsible for maintaining the security of your device and app installation. If you lose access to your device or delete the app, you may lose your connection with your partner and need to re-establish it.
4. User Conduct
You agree to use OneOhOne only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the App to harass, abuse, or harm another person
- Send unwanted invitations or use the App to spam others
- Attempt to interfere with or disrupt the App's operation
- Attempt to access another user's data without authorization
- Use the App for any commercial purpose without our permission
- Reverse engineer, decompile, or attempt to extract the source code of the App
5. Privacy
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
6. Intellectual Property
The App and its original content, features, and functionality are owned by OneOhOne and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.
7. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:
- The App will be uninterrupted, secure, or error-free
- The results obtained from using the App will be accurate or reliable
- Any errors in the App will be corrected
YOU USE THE APP AT YOUR OWN RISK.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONEOHONE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
- Your use or inability to use the App
- Any unauthorized access to or use of our servers
- Any interruption or cessation of transmission to or from the App
- Any bugs, viruses, or similar issues transmitted through the App
9. Important Health Disclaimer
OneOhOne is not a medical device or emergency service. The App is designed for social connection and is not intended to monitor health conditions or replace emergency services. If you have concerns about someone's safety or health, please contact appropriate emergency services or healthcare providers directly. The absence of a check-in should not be relied upon as an indicator of a medical emergency.
10. Indemnification
You agree to indemnify and hold harmless OneOhOne and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the App or violation of these Terms.
11. Termination
We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last updated" date at the top of this page. Your continued use of the App after any changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
14. Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in California, and the arbitrator's decision shall be final and binding.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and OneOhOne regarding your use of the App and supersede any prior agreements.
